Terms of Service

Agreement

These Terms of Service ("Terms") are an agreement between you and Tekglobal Partners INC, an Indiana corporation doing business as SuperIQ ("SuperIQ", "we", "us"). By creating an account or using superiq.io or the SuperIQ software (the "Service"), you agree to these Terms. If you use the Service for a business, you agree on its behalf.

Accounts

You must be at least 18 and give accurate information. You're responsible for your login credentials and all activity in your account.

Plans, trials and billing

Subscriptions are billed in advance, monthly or yearly, through Stripe, and renew automatically until cancelled. Introductory offers (for example, $49/mo for the first 3 months, then $97/mo) convert to the standard price when the offer period ends. Free trials convert to a paid subscription at the end of the trial unless you cancel before it ends. Prices may change with at least 30 days' notice.

Usage charges

Phone, SMS, email, WhatsApp and similar usage is billed separately on a pay-as-you-go basis at the rates shown in your account. Carrier, registration and third-party fees may apply.

Cancellation and refunds

There is no long-term contract. You can cancel anytime; cancellation takes effect at the end of the current billing period and you keep access until then. Fees already paid are non-refundable except where required by law.

Acceptable use

You agree not to use the Service to send spam or unsolicited messages; to contact people without the consent required by law; to violate the TCPA, CAN-SPAM, carrier rules, A2P 10DLC registration requirements or any other law; to infringe others' rights; to distribute malware; or to interfere with the Service. We may suspend accounts that violate these rules.

Your data

You own the data you put into the Service. You grant us a limited license to host and process it to provide the Service. You're responsible for its accuracy and for having the right to use it. Our Privacy Policy explains how we handle information.

Our property

The Service, software and SuperIQ brand belong to us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Some features rely on third-party providers whose terms may also apply.

Availability and changes

We work to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may add, change or remove features.

Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not guarantee any particular business results.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

Indemnity

You will defend and indemnify us against claims arising from your use of the Service, your data or messages, or your breach of these Terms or the law.

Termination

You may stop using the Service at any time. We may suspend or end your access if you breach these Terms or fail to pay. Sections that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Marion County, Indiana, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms. We'll post the new version here and update the date above; continuing to use the Service means you accept the changes.
